1. About the service

i-Send is an email marketing platform operated by Bespoke Software Ltd, a company registered in England and Wales (company number 06406391). i-Send is currently in development, and access is provided by individual arrangement (early access). These terms apply to any use of the service.

2. Accounts

The service is provided for business use. You must provide accurate account information and keep it up to date, keep your credentials confidential, and you are responsible for all activity under your account.

3. Acceptable use

Use of the service is subject to the i-Send Acceptable Use Policy, which forms part of these terms. You must also comply with applicable law, including UK GDPR and the Privacy and Electronic Communications Regulations (PECR).

4. Fees and payment

Fees and payment terms are set out in a separate agreement between you and us.

5. Availability

We provide the service with reasonable skill and care. We do not guarantee that the service will be uninterrupted or error-free, and we do not offer a guaranteed level of availability. While the service is in development, features may change or be withdrawn.

6. Liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law of England and Wales, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential losses, loss of profits, or loss of business, and our total liability under these terms is limited to the fees you paid to us in the twelve months before the event giving rise to the claim.

7. Suspension and termination

We may suspend or terminate your access if you materially breach these terms or the Acceptable Use Policy. You may stop using the service and close your account at any time. On closure, your data is handled as described in the Privacy Policy.

8. Changes to these terms

We may update these terms from time to time. We will give notice of material changes by email or by a notice on this website before they take effect.

9. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
